No Misuse of the Site

RAC’S TOTAL LIABILITY UNDER THESE TERMS OF USE IS LIMITED TO THE AMOUNT YOU PAID TO USE THE SITE, IF ANY. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE OR ITS SERVICES IS TO STOP USING THEM.
Indemnity
UPON RAC’S REQUEST, YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS RAC, ITS AFFILIATES, AGENTS, BUSINESS PARTNERS, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND LICENSEES FROM ALL LIABILITY, INCLUDING COSTS, EXPENSES, AND ATTORNEYS’ FEES, ARISING OUT OF OR RELATED TO YOUR VIOLATION OR MISUSE OF THE SITE.
RAC MAY, AT ITS OWN EXPENSE, ASSUME THE EXCLUSIVE DEFENSE AND CONTROL OF ANY MATTER SUBJECT TO INDEMNIFICATION BY YOU, AND YOU AGREE TO COOPERATE WITH RAC IN ASSERTING ANY AVAILABLE DEFENSES.
Termination and Removal of Materials
In addition to any other remedies available to it, RAC may, at its sole discretion, with or without cause and with or without notice, withdraw, suspend, or discontinue any materials, services, accounts, credentials, features, or functionality on this Site at any time.
Limited Distribution and Territorial Considerations
This Site is controlled and operated by RAC from its offices in the United States. RAC makes no representation that the materials on this Site are appropriate or available for use in other locations. If you access the Site from elsewhere, you do so on your own initiative and are responsible for complying with any local laws that apply. Nothing on the Site is an offer to provide goods or services in any place where doing so would be unlawful.
Governing Law and Jurisdiction
These Terms of Use are governed by and construed in accordance with the laws of the Commonwealth of Virginia, as applied to agreements made and performed entirely within Virginia, and without giving effect to any conflict-of-laws principles. You agree that any lawsuit or other action brought by RAC, its Affiliates, you, or any third party to enforce these Terms of Use, or in connection with any matter related to this Site, will be subject only to the jurisdiction of the state or federal courts located in the Commonwealth of Virginia.
Modifications
RAC may change or modify these Terms of Use at any time. They may be modified only in writing, as posted on this Site, and any change takes effect immediately upon posting. General Provisions
Except as stated here, these Terms of Use are the entire agreement between you and RAC about your use of this Site and replace all earlier or simultaneous communications and proposals, whether oral, written, or electronic. Additional terms may apply when you use content, software, or services supplied to this Site by third parties. Rights not expressly granted here are reserved by RAC.
If RAC does not exercise or enforce a right or provision of these Terms of Use, that is not a waiver of it. If a court of competent jurisdiction finds any part of these Terms of Use invalid or unenforceable, that part will be interpreted as nearly as possible to reflect the parties’ original intent, and the rest will remain in full force. Regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to your use of this Site must be filed within one (1) year after it arises, or it is permanently barred.
